Welcome to Molly's Herbals! The terms "we", "us", and "our" refer to Molly's Herbals and its operations, including the store and website ("Services"). These Terms of Service govern your use of the Services. By accessing or using the Services, you acknowledge acceptance and agree to be bound by these Terms and our Privacy Policy. If you disagree, please discontinue use of the Services.

1. Access and Account

You affirm that you are at least 18 years of age and liable for actions of any dependents using the Services through your accounts or devices. You must provide accurate, up-to-date account and payment information and are responsible for securing your account credentials. Transfer or sharing of your account is prohibited.

Marketing Communications Consent: If you opt in to receive SMS text messages or email marketing from us, you consent to receive recurring automated marketing messages at the phone number or email address provided. Message and data rates may apply. Consent to receive marketing messages is not a condition of purchase. You may opt out of SMS messages at any time by replying "STOP," and may unsubscribe from marketing emails using the link provided in each email.

2. Our Products & Disclaimer

While all efforts are made to represent products accurately, display and appearance may vary by device. We do not guarantee the appearance or quality of products compared to online depictions. Descriptions are subject to change, and product offerings may be discontinued without notice. Quantities may be limited by person or region.

Disclaimer: Molly's Herbals products are natural herbal dietary supplements for animals. These statements have not been evaluated by the U.S. Food and Drug Administration or USDA. Our products are not intended to diagnose, treat, cure, or prevent any disease. We do not guarantee or claim specific health outcomes. Always consult a qualified veterinarian or healthcare provider before beginning any new supplement program for your animals. Use of our products is at your own discretion and risk.

Information provided on this site, including product descriptions, usage guidance, and educational content — including educational content hosted on affiliated resources such as Fias Co Farm — is provided for informational and educational purposes only. It is not intended as veterinary or medical advice and should not be relied upon as such. Individualized dosing, formulation, or usage guidance found in educational content is not a substitute for consultation with a qualified veterinarian familiar with your animal's specific circumstances. Individual animals may respond differently to herbal products. You assume full responsibility for determining whether a product is appropriate for your animals.

3. Orders, Refund/Return and Subscriptions Policy

Placing an order constitutes an offer to buy. Orders are accepted only once we confirm and process payment. Please confirm order details before submission—modifications or cancellations may not be possible. Purchases are intended for personal use only. Resale of Molly's Herbals is expressly prohibited. We reserve the right to suspend access and ability to order for violations.

Refunds, Returns & Exchanges: Please inspect your order upon receipt and contact us immediately at contactmolly@mollysherbals.com if items are incorrect or damaged. Due to the organic nature of our products, we maintain a strict 30-day return/exchange/replacement policy from the delivery date. Initial shipping charges are non-refundable. No refunds will be issued on new/unopened products without a Return Authorization from Molly's Herbals via email. We cannot accept returns of opened or used products for health and safety reasons. If you receive an incorrect item, we will issue a prepaid return label.

Subscriptions:

Subscription products are billed automatically based on the selected delivery interval until canceled. You may manage or cancel subscriptions through your account prior to the next billing date. Subscription charges are non-refundable once processed.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price applicable is the one at order submission. Prices exclude taxes, shipping, handling, and international fees unless otherwise noted. If your billing info becomes outdated, you are responsible for updating it promptly and ensuring successful transactions.

Molly's Herbals will automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the states where Molly's Herbals is legally required to do so. For orders shipped to other areas, you (the shopper) are solely responsible for any sales taxes and/or other taxes that may apply.

We reserve the right to correct pricing errors and cancel orders resulting from such errors.

5. Shipping and Delivery

Shipping or delivery delays are outside our control—delivery windows are estimates only. Risk of loss and title for items pass to you upon delivery to the carrier. Molly's Herbals is not responsible for lost, stolen, or delayed shipments once transferred to the carrier.

6. Intellectual Property

All services, content, and branding on our platform are protected by law and remain property of Molly's Herbals or its licensors. You are granted limited personal, non-commercial usage rights only—not rights to reproduce or redistribute protected material without written consent. We reserve the right to suspend access for violations. This includes, without limitation, formulas, recipes, herbal combinations, and educational materials.

7. Third-Party Services

Our site may integrate third-party tools, links, or platforms (such as Shopify). These are provided "as is" without warranty. We are not liable for issues arising from their use. Refer to their individual terms and policies.

8. Privacy Policy

Any personal information collected through the Services is governed by our Privacy Policy. Shopify may also collect and process information to maintain and improve the Services. Depending on your state of residence, you may have additional rights regarding your personal information, including the right to access, correct, or delete your data, and to opt out of certain data uses. 9. User-Generated Content

If you submit product reviews, testimonials, photos, comments, or other content to the Services, you grant Molly's Herbals a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing. You represent that you have the right to submit the content and that it does not violate any third party's rights. We reserve the right, but have no obligation, to monitor, edit, or remove any user-generated content at our discretion. Posting content does not imply our endorsement of the views expressed.

10. Feedback

Any feedback, suggestions, or ideas submitted to us may be used by Molly's Herbals without obligation or compensation. Submission of feedback does not create any confidentiality or ownership rights.

11. Errors, Inaccuracies, Omissions

We may correct any errors in listings—including prices, product info, or availability—without notice, even if orders are already placed.

12. Prohibited Use

You must use the Services lawfully. Prohibited behaviors include unauthorized scraping, uploading malware, infringing on others' rights, attempting to extract proprietary formulas, recipes, or dosage methodologies through automated or manual means. We reserve the right to suspend access for violations.

13. Termination

We may suspend or terminate access at our discretion. Sections such as Indemnification, Intellectual Property, etc., continue post-termination.

14. Disclaimer of Warranties

Except where required by law, services and goods are provided "as is" without warranty of any kind.

15. Limitation of Liability

To the maximum extent allowed by law, we are not liable for direct or indirect damages resulting from use of our Services or products. In no event shall Molly's Herbals' total liability to you for all claims arising from or relating to the Services or products exceed the amount you paid for the specific product giving rise to the claim in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages, except where such limitation is prohibited by law.

16. Indemnification

You agree to indemnify us for claims arising from your violation of these Terms, misuse of the Services, or infringement of third-party rights.

17. Dispute Resolution; Arbitration Agreement; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court, you and Molly's Herbals agree to resolve any dispute arising out of or relating to these Terms or the Services through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be administered by a mutually agreed-upon arbitration organization under its applicable rules. The arbitration will be conducted in Hamilton County, Ohio, unless you and Molly's Herbals agree otherwise.

YOU AND MOLLY'S HERBALS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Molly's Herbals agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

You have the right to opt out of this arbitration agreement by sending written notice to contactmolly@mollysherbals.com within 30 days of first accepting these Terms.

18. Governing Law; Venue

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws principles. Subject to the arbitration agreement above, you agree that any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to personal jurisdiction in those courts.

19. Accessibility

We are committed to making our Services accessible to all users. If you experience difficulty accessing any part of our Services or have suggestions for improvement, please contact us at contactmolly@mollysherbals.com so we can assist you and address the issue.

20. Miscellaneous

Severability: If any provision is deemed unenforceable, it does not affect the validity of the remaining Terms.

Waiver & Entire Agreement: Failure to enforce any right does not waive that right. These Terms constitute the entire agreement between us.

Assignment: You may not assign these Terms without our consent. We may transfer our rights at will.

Headings: Section headings are for convenience and do not affect interpretation.

Force Majeure: Molly's Herbals shall not be liable for delays or failure in performance due to events beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, labor shortages, carrier delays, or governmental actions.

21. Changes to Terms

We may update these Terms—material changes will be communicated directly to you. Continued use of the Services after changes constitutes acceptance. Updated Terms will be posted on this page with a revised effective date.
